Contractual Framework

This digital interface is the property of Nutra Blink (Exibyte LLC). Throughout this document, “we,” “us,” and “our” refer to Nutra Blink. By accessing our platform, you enter a binding legal contract with us, conditioned upon your unqualified acceptance of every provision, protocol, and policy articulated here.

Applicability

These Terms of Service function as a mandatory agreement for all participants on the platform, encompassing casual visitors who browse the interface, merchants or vendors who provide content and products, and registered consumers consisting of individuals or organizations executing transactions.

Hosting Infrastructure

Our digital architecture is sustained by Shopify Inc., which provides the enterprise-grade e-commerce engine necessary for the secure distribution of our goods and Services.

 

User Representation

By engaging with our Services, you verify that you have attained the legal age of majority in your jurisdiction. You assume full responsibility for any minor dependents you permit to navigate this site.


Prohibited Conduct and System Integrity

Users are strictly forbidden from engaging in illicit activity such as using products for any unauthorized or illegal venture, cyber interference like deploying malware or destructive code, and intellectual property theft by reproducing or exploiting any part of the service without explicit written consent. Additionally, automated data extraction using spiders, crawlers, or scrapers to harvest proprietary or user information is prohibited.


Inventory and Dynamic Pricing


Regarding inventory and pricing, we reserve the right to adjust commodity pricing without prior announcement, modify or discontinue any specific product or service at our sole discretion, and maintain that we cannot guarantee your hardware's color calibration will accurately reflect the physical product despite our use of high-fidelity imaging.

For order management, we reserve the unilateral right to reject or cancel any order and may implement purchase limits per individual account, billing or shipping address, or credit card identifier, a measure specifically designed to mitigate unauthorized distribution or reseller activity.

 

User Submissions and Feedback

If you transmit creative materials, plans, or suggestions to us, you grant Nutra Blink a perpetual, royalty-free, and irrevocable license to edit, publish, and distribute those materials globally. We are not obligated to provide compensation or maintain the confidentiality of unsolicited feedback.


Third-Party Ecosystems

Our platform may integrate with or link to third-party tools and websites.

  • As-Is Provision: These tools are provided without warranties of any kind.

  • Independent Liability: We do not endorse, nor are we responsible for, the content, security, or business practices of external entities. All transactions with third parties are at the user's sole risk.


Warranties and Service Continuity

We do not represent that your access to our Service will be uninterrupted, secure, or error-free. You expressly acknowledge that the Service and all products are delivered on an “as is” and “as available” basis, devoid of all implied warranties of merchantability or fitness for a particular purpose.


Limitation of Liability

In no event shall Nutra Blink, its directors, officers, or employees be liable for any financial loss, including lost profits, revenue, or savings; for any data loss, including corruption, deletion, or compromise of digital assets; or for any consequential, incidental, or punitive damages arising from the use of the platform.

Indemnification Mandate

You agree to indemnify and hold Nutra Blink harmless from any third-party claims, legal fees, or demands resulting from your violation of these Terms or the infringement of any international or local laws.

 

Severability and Entirety

Should any clause within this agreement be deemed void or unenforceable by a court of competent jurisdiction, that specific provision shall be severed. This act shall not impact the validity or enforceability of the remaining sections. These Terms represent the entire agreement between the user and the company.


Governing Law

These Terms and any separate agreements for the provision of Services shall be governed by and interpreted in accordance with the laws of the United States.


Modification of Terms

We reserve the right to revise these Terms at any time. It is the user's responsibility to monitor this page for updates. Continued use of the platform following updates constitutes an automatic acceptance of the revised Terms.
